Either, scoped at engagement. Some counsel retain us as consulting experts for settlement strategy and rebuttal; others disclose us as testifying experts. The analysis is built to the same standard regardless, because consulting work has a way of becoming testimony.

Yes. Rebuttal-only engagements are common — we audit normalization adjustments, comparable selection, discount rates, and standard-of-value application, and document where the opposing conclusion fails its own methodology.

Fair market value assumes a hypothetical willing buyer and seller and typically permits minority discounts. Fair value — the standard in many California shareholder remedies — often excludes those discounts. Applying the wrong standard is one of the most common, and most fatal, expert errors; we get it right and put it in writing.
